1. Definitions

1.1 “Seller” shall mean Slingshots Australia, its successors, assigns, or any person acting on behalf of and with the authority of Slingshots Australia, located at Gold Coast, Queensland.
1.2 “Buyer” shall mean the Buyer or any person acting on behalf of and with the authority of the Buyer, as described on any quotation, order, or form provided by the Seller.
1.3 “Goods” shall mean all goods supplied by the Seller to the Buyer, including slingshots, bands, and accessories, as described on invoices, quotations, or other forms provided via the Seller’s website (www.slingshots-australia.com.au).
1.4 “Price” shall mean the price payable for the Goods as agreed between the Seller and the Buyer.

2. Australian Consumer Law

2.1 Nothing in this agreement is intended to contract out of any applicable provisions of the Australian Consumer Law or state Fair Trading Acts, except to the extent permitted by those laws.

3. Acceptance

3.1 By placing an order or accepting Goods, the Buyer agrees to these terms and conditions.
3.2 Product descriptions, specifications, and images on the Seller’s website are approximate and may vary slightly. The Seller reserves the right to supply Goods with minor modifications.
3.3 These terms prevail over any conflicting terms in the Buyer’s order, notwithstanding any terms in the Buyer’s order that purport to override these terms.

4. Compliance with Local Laws

4.1 The Buyer is responsible for ensuring compliance with all local laws regarding the purchase, possession, and use of Goods, including slingshots, which are prohibited weapons in certain states (e.g., New South Wales, Victoria, South Australia, Western Australia, and Northern Territory).

4.2 The Seller restricts sales and shipments of slingshot "Y" frames to Queensland, the Australian Capital Territory (ACT), and Tasmania, where slingshots are legal without permits.

No slingshot Y-frames will be shipped to New South Wales (NSW), Victoria, South Australia, Western Australia, or the Northern Territory, where they are classified as prohibited weapons or restricted. Orders to these states containing a slingshot Y-frame in the cart will be blocked at checkout, and any orders that bypass this restriction will be cancelled.

Unrestricted items, such as bands, targets, clay ammo, and accessories that are not restricted can be shipped nationwide, including to NSW, Victoria, South Australia, Western Australia, and the Northern Territory. Customers in these restricted states are welcome to purchase these items without any limitations.

5. Price and Payment

5.1 The Price is as indicated on the Seller’s website (www.slingshots-australia.com.au) or invoice at the time of order.
5.2 The Seller may adjust the Price if the order varies from the original quotation.
5.3 Payment is required before shipping and must be made via Shopify Payment Gateway or PayPal.
5.4 GST and applicable taxes are added to the Price at checkout unless expressly included.

6. Delivery

6.1 Delivery occurs when the Buyer or their nominated carrier takes possession of the Goods at the Seller’s address or the Buyer’s nominated address in Queensland, ACT, or Tasmania.
6.2 All orders are fulfilled and shipped within 1 business day.
6.3 Shipping costs and estimated timeframes are as follows:

• Free Shipping: Orders over $99.

• Standard Shipping: $7.95 for orders below $99 (2-7 business days for metropolitan areas like Brisbane and Gold Coast; 2-8 business days for regional Queensland, ACT, and Tasmania).

• Express Shipping: $12.95 (1-2 business days for metropolitan areas; 1-3 business days for regional Queensland, ACT, and Tasmania).

• Note: Shipping timeframes are estimates only and may vary due to factors beyond the Seller’s control.
  6.4 The Buyer must accept delivery when tendered. If the Buyer is unable to accept delivery, the Seller may charge a reasonable redelivery fee.
  6.5 Delivery to a third party nominated by the Buyer is deemed delivery to the Buyer.
  6.6 The Seller is not liable for delays or non-delivery due to circumstances beyond its control, including postal service delays or acts of God.

7. Risk and Title

7.1 Risk passes to the Buyer upon delivery.
7.2 Ownership remains with the Seller until full payment is received and all Buyer obligations are met.
7.3 If Goods are damaged or destroyed after delivery but before ownership passes, the Seller is entitled to any insurance proceeds, and these terms serve as evidence of that right.

8. Warranty and Returns

8.1 All Goods are resold and subject to the manufacturer’s warranty, as provided by the original manufacturer.
8.2 Returns are subject to inspection by the Seller. Defective Goods may be replaced or refunded at the Seller’s discretion, provided the defect is reported within the manufacturer’s warranty period and is not due to misuse, improper maintenance, or fair wear and tear.
8.3 Non-defective returns may incur a restocking fee and are subject to the Seller’s approval.
8.4 The Seller is not liable for delays in processing returns or assessing claims.

9. Cancellations

9.1 The Seller may cancel orders before delivery, refunding any payments without liability for any loss or damage arising from cancellation.
9.2 If the Buyer cancels an order, they are liable for any losses incurred by the Seller, including but not limited to loss of profits, up to the time of cancellation.

10. Privacy

10.1 The Seller will not share the Buyer’s personal information without consent, using it only for order processing, shipping, and notifying Buyers of website updates or promotions.
10.2 Personal information is stored securely and not sold or rented to third parties.
10.3 Changes to privacy practices will be communicated via the Seller’s website (www.slingshotsaustralia.com.au), with options for Buyers to opt out of new uses of their information.

11. General

11.1 These terms are governed by the laws of Queensland and subject to the exclusive jurisdiction of Queensland courts.
11.2 The Seller is not liable for indirect losses, including loss of profit, arising from breaches of these terms.
11.3 If any provision of these terms is invalid, void, or unenforceable, the remaining provisions remain valid and enforceable.
11.4 The Seller may amend these terms at any time, with changes effective upon notification to the Buyer via the website or email.
11.5 Neither party is liable for defaults due to events beyond their control, including acts of God, strikes, or natural disasters.
11.6 The Seller may license or subcontract its rights and obligations without the Buyer’s consent.
11.7 The Seller’s failure to enforce any provision does not waive its right to enforce it later.
